Staples Sued Over Underpaid Overtime Wages

A class action has been filed in California state court alleging that Staples The Office Superstore, LLC (Staples) has underpaid overtime wages to its hourly employees.

The complaint alleges that hourly wage employees of Staples are paid additional commission wages, but that Staples failed to include those commission wages in calculating employees’ rate of pay for the purpose of determining over time wages, in violation of California law.  The complaint says that the practice has resulted in “systematic underpayment” of compensation for overtime work.

Staples previously agreed to pay $42 million to settle a series of class action lawsuits alleging that they misclassified assistant store managers for the purpose of paying overtime wages under the federal Fair Labor Standards Act.
